Korea Rental Deposit Not Returned: What to Do Before Moving Out

Before moving without your Korean rental deposit, document the unpaid balance, check your protection and guarantee, and get case-specific legal guidance.

If the landlord has not returned the deposit at the end of a Korean lease, do not treat the move as only a key-handover appointment. First confirm how the lease ended, preserve proof of the amount due and payment request, check any deposit-return guarantee, and obtain advice about the effect of moving, changing your reported address, or surrendering possession.

  1. Confirm the lease end. Identify the contractual end date, renewal history, termination notice, acceptance, and any agreed handover date.
  2. State the unpaid amount in writing. Ask when and how the balance will be returned, and preserve proof that the message was delivered.
  3. Freeze the evidence. Save the lease, deposit transfers, address and fixed-date records, guarantee documents, condition photos, messages, and proposed key handover.
  4. Call the guarantee provider now. If a guarantee was issued, ask for the current claim route, documents, deadlines, and duties under your certificate.
  5. Check your legal position before changing it. Ask qualified help how moving, handing over keys, changing the reported address, accepting partial payment, or signing a settlement may affect your case.
  6. Ask about the appropriate formal route. Depending on the facts, that may include a leasehold registration order, mediation, a payment order, litigation, guarantee performance, or another procedure.

The official Easy Law guidance says that when a housing lease ends, the tenant returns the dwelling and the lessor returns the deposit. It also explains that the lease is treated as continuing until the deposit is returned and describes several possible recovery procedures. Those general rules do not tell you which procedure fits your documents or whether a specific move is safe.

First Confirm That the Lease Actually Ended

A deposit may be unpaid because the owner disputes that the lease ended, disputes the date, expects a new tenant, claims damage or unpaid charges, or cannot pay. Before choosing a remedy, build one written timeline:

  • the original start and end dates
  • every renewal, extension, or changed contract
  • the notice you gave or received, its delivery date, and how delivery is proved
  • the date the other party accepted termination, if there is an agreement
  • the planned move-out, inspection, key handover, and deposit-return dates
  • any condition attached to early termination or replacement of the tenant

Do not assume an unanswered message, a broker's verbal statement, or the date printed on the first contract settles termination. Renewal and notice rules can be fact-sensitive. Send the timeline and documents to a qualified adviser if the other party disputes the end of the lease.

Send a Clear Written Deposit-Return Request

Use a written message that identifies the contract, property, lease-end basis, deposit paid, any undisputed deductions, amount requested, proposed return date, account, and a request for a written response. Keep the language factual. Do not threaten a procedure you have not verified.

Please confirm the lease-end date and the remaining rental deposit to be returned for [property]. My records show a deposit of [amount], payments of [amount], and an unpaid balance of [amount], subject to any itemized amount we both verify in writing. Build an Evidence File Before the Handover Date

Make a read-only folder and a separate backup. Keep originals where possible and record when each copy was made. Include:

  • the final signed lease, attachments, special clauses, and later amendments
  • the exact Korean property address and unit
  • deposit, rent, management-fee, utility, and other payment records
  • receipts and the purpose of each payment
  • the property registry copies you obtained at relevant stages
  • possession, place-of-stay report, fixed-date, and lease-report evidence
  • the deposit-return guarantee certificate, terms, application, and provider messages
  • renewal, termination, repair, deduction, inspection, and return communications

Do Not Confuse the Deposit With Every Other Amount

Prepare a reconciliation sheet that separates the principal rental deposit from rent, management fees, utilities, restoration, cleaning, damage claims, interest, or other amounts. For every deduction, ask for:

  • the amount
  • the contract clause or legal basis being claimed
  • the invoice, receipt, photo, inspection record, or calculation
  • whether you agree, dispute, or need more evidence
  • the undisputed balance that can be returned now

Ask the provider to confirm in writing:

  • the policy or certificate number and coverage period
  • whether the reported lease-end event fits the current claim process
  • the current application or notice deadline for this contract
  • all required termination, payment, registration, possession, address, and return-demand evidence
  • whether moving, returning keys, changing address, renewing, settling, or accepting partial payment requires notice or consent
  • what continuing cooperation or rights-transfer duties apply
  • which exclusions or non-covered obligations may matter

Why Moving Out Needs Case-Specific Advice

Possession, the registered place of stay, a fixed date, a residential lease report, and a guarantee are separate records with different effects. Giving up possession, handing over every key, changing an immigration address, or signing a final settlement can affect the evidence or legal position a tenant is relying on.

That does not mean every renter must remain in the property. It means the decision should follow a review of the actual timeline, legal protection, guarantee terms, and available procedure. A favorable document does not automatically make money available.

Should I hand over the keys if the deposit has not arrived?

Can I deduct unpaid rent from the deposit myself?
