Korea Rental Deposit Protection for Foreigners: Fixed Date, Address Report and Guarantee
Protecting a Korean rental deposit can require possession, a reported place of stay, a fixed date and a separate guarantee review; verify each step.
The direct answer is that a signed lease or a large bank transfer does not by itself establish every form of deposit protection. The official Korean guidance separates possession of the dwelling, the residence-registration equivalent available to a foreign tenant, a fixed date on the lease, any applicable lease report, and eligibility for a deposit-return guarantee.

The safest working method is to keep proof for every separate step and ask each office what its record shows. A receipt from one system may be useful evidence, but it should not be treated as proof that every other system is complete.
What the Housing Lease Protection Rules Require
The Ministry of Government Legislation's current English housing lease deposit guidance explains two concepts that renters often combine:
- Opposing power against third parties: the official summary connects this to delivery of the dwelling and completion of resident registration. It states that the effect arises from the following day when those conditions are met.
- Preferential repayment right: the same guidance explains that the opposing-power conditions and a fixed date on the lease agreement must be in place.
For foreign nationals, the official page says alien registration, notification of a change of place of stay, a domestic-abode report or a change-of-abode report can be recognized as the resident-registration equivalent for this housing-law purpose. It also states that foreign nationals can use their alien registration number to obtain a fixed date.
That general explanation does not decide whether your particular home, lease, registration, timing or evidence satisfies the current law. Use the current Housing Lease Protection Act record and obtain case-specific advice when priority, an auction, existing security rights, a company lease, an unusual residence status or a disputed move-in date is involved.
Step 1: Record When You Actually Took Possession
Keep evidence of the actual handover and occupancy, not only the contract date. Depending on the facts, that folder may include the handover message, key receipt, move-in inspection, utility opening record, building-access record, dated condition photos and communication confirming the balance payment and possession.
If the contract date, balance-payment date, key handover and real move-in date are different, do not choose the most convenient date yourself. Step 2: Complete the Correct Foreigner Address Report
Current Article 36 of the Immigration Act says a registered foreigner who changes the place of stay must report the move within 15 days from moving in, to the responsible local authority or immigration office, and present the residence card. Save the receipt, online confirmation, card update or other official evidence the office provides. A submitted application, a broker's message or a landlord's acknowledgment is not the same as confirmation that the correct authority accepted the report for the correct property.
Step 3: Obtain and Verify the Fixed Date
A fixed date is an official date attached to the lease record for the priority framework described in the housing guidance. It is not merely the date printed next to the signatures. Ask the handling office to identify:
- whether the final signed lease, rather than an earlier draft, was used;
- the property and unit recorded;
- the tenant identity or registration number used;
- the fixed date entered in the system;
- which receipt, certificate or marked contract proves the result; and
- whether a corrected or replaced contract needs another step.
Do not alter an original receipt or contract mark. Store a scan and a separate photo, and keep the physical record where it will remain available if the phone holding the first copy is lost.
Does a Korea Lease Report Give You a Fixed Date?
The official Easy Law guide says that when an applicable residential lease is reported and the lease agreement is submitted, the submission is deemed an application for a fixed date. This can make one filing relevant to two records, but it does not mean that every lease falls within the reporting rule, that every submission was accepted, or that possession and the foreigner's change-of-place-of-stay report are complete.
Check the current rule and filing status through the official Real Estate Transaction Management System or the local office responsible for the property. Do not rely on an old online threshold, a broker's generic statement or another tenant's receipt. Reporting scope, exceptions, forms and system screens can change.
If you expected a fixed date through the lease report, ask for evidence that the report was accepted and that the fixed-date application attached to the correct final lease. Keep the filing number, submission copy, acceptance record and any correction notice.
Step 4: Check a Deposit-Return Guarantee Separately
A deposit-return guarantee is a product with its own application, document, underwriting, timing and claim conditions. It is not the same as opposing power or a preferential repayment right, and those statutory concepts do not mean a provider must approve a guarantee.

Some provider pages describe documents using resident-registration terminology. Questions to ask before relying on a guarantee
- Is this tenant type and residence status eligible?
- Is this exact property type, ownership structure and use eligible?
- Does the contract form, term, deposit-payment evidence and fixed-date record meet the current rules?
- What is the application deadline for this product and contract?
- Which registry, valuation, debt, tax, occupancy or other checks will the provider conduct?
- What exclusions, continuing duties, renewal steps and claim conditions apply?
- What written document proves issuance, and when does coverage begin and end?
HUG, the Korea Housing Finance Corporation and Seoul Guarantee Insurance are among the institutions named in the official Easy Law guidance, but products and access routes differ. A Practical After-Signing Sequence
- Freeze the evidence. Save the final lease and attachments, registry document reviewed, broker documents, payment evidence, receipts, messages and move-in records.
- Confirm possession. Record the real handover and occupancy facts without rewriting dates to fit a desired outcome.
- Report the correct place of stay. Use the responsible authority or current HiKorea route and save acceptance evidence.
- Verify the fixed date. Confirm the final lease, property, identity and date recorded.
- Check lease-report status. If the current rule applies, confirm acceptance and whether submission of the lease produced the fixed-date application.
- Request a guarantee review promptly. Do not wait until the end of the lease or assume the broker will apply for you.
- Compare every record. Resolve spelling, address, unit, party, deposit, date or contract-version mismatches with the responsible institution.

Create a read-only folder with filenames that show the date and document version. Keep:
- the listing, exact Korean address and unit details;
- the final signed lease, every special clause and any later amendment;
- the real-estate register and other property records reviewed before payment;
- owner or representative identity and authority evidence you were lawfully given;
- broker registration and confirmation/explanation documents;
- every transfer record and written receipt, with the purpose of each payment;
- key handover, move-in, condition and occupancy evidence;
- the accepted foreigner address-report evidence;
- the fixed-date record and any lease-report receipt;
- guarantee consultation, application, requested-document, decision and policy records; and
- renewal, termination, repair, move-out and deposit-return communications.
Protect personal information. Do not post another person's identification number, signature, bank account, registry details or a full unredacted lease in a public forum. If a professional needs the original, use a secure channel and confirm who will receive it.
Red Flags That Need Individual Review
Pause and get current, case-specific help when:
- the landlord, owner, representative, payment recipient or contract party does not match;
- the unit in the lease differs from the unit occupied or reported;
- the final lease differs from the document used for the fixed date or lease report;
- possession, address reporting and fixed-date records occurred in an unclear order;
- the registry changed between contract signing, final payment and move-in;
- the property is used, registered or divided differently from what you were told;
- a guarantee provider requests corrections or says the property or contract is outside its current scope;
- you are asked to cancel a report, move your registered address, return keys or sign a new document without understanding the effect; or
- an auction, seizure, unpaid-deposit dispute or suspected fraud has appeared.

If You Missed a Step or Found a Mismatch
Act promptly, but do not invent a date, backdate a document or rely on a verbal promise that a record will be corrected. Ask the responsible office or provider what its system currently shows, what can still be filed or corrected, which evidence is required and from what time any legal or product effect may operate.
When the deposit is already at risk, moving out, handing over every key, changing the reported address, signing a termination paper or accepting a partial payment may affect your position. Please confirm the exact Korean property address and unit, the final lease version, the actual possession date, the place-of-stay report accepted for this address, the fixed date recorded on this lease, whether a residential lease report was required and accepted, and which current deposit-return guarantee products may review this tenant, property and contract. Please identify the official receipt or certificate for each completed step and tell me which institution must answer any item you cannot verify.
A useful answer identifies a document, institution, filing number, date and next action. “It is protected,” “everyone does it this way” or “the guarantee will be fine” is not enough evidence.

Is an address report the same as a fixed date?
No. The official guidance describes the foreigner's registration or place-of-stay report as the resident-registration equivalent for the opposing-power condition, while a fixed date is an additional condition for preferential repayment. Confirm both records.
Does a fixed date guarantee that I will get the entire deposit back?
